A Zambian Court Rules Former Leader Lungu Can’t Run for President again in

On December 10, 2024, Zambia’s Constitutional Court unanimously ruled that former President Edgar Chagwa Lungu is ineligible to contest the 2026 presidential election, having already served the maximum two terms permitted by the constitution.

Lungu’s tenure began in 2015 following the death of then-President Michael Sata, leading to his election for the remainder of Sata’s term. He was subsequently re-elected in 2016, serving until 2021. The court determined that his initial period in office constitutes a full term, thereby reaching the constitutional limit of two terms.

This decision has significant implications for Zambia’s political landscape, particularly concerning the rivalry between Lungu and current President Hakainde Hichilema, who defeated Lungu in the 2021 election. The ruling was broadcast live, reflecting the high public interest in the matter.

Lungu has criticized the verdict, alleging political manipulation and judicial interference, especially following the dismissal of three judges who had previously ruled in his favor. He contends that the charges against him and his family are politically motivated attempts to undermine his political career.

Despite the court’s decision, the vice president of Lungu’s party has stated that they will continue to support his candidacy in 2026. This stance suggests potential ongoing legal and political challenges as the election approaches.

The court’s ruling underscores the importance of constitutional adherence in Zambia’s democratic processes and sets a precedent for the interpretation of presidential term limits.
